Data protection and privacy policy

Data Protection and Privacy Policy Morris Meetings & Incentives, LLC and Morris Murdock, LLC (collectively Morris) are committed to protecting the information of visitors to its websites and all users of its products and services. The following Data Protection and Privacy Policy (Privacy Policy) provides details regarding any type of personal information that relates to an identified or identifiable individual (Personal Data) that Morris may collect, gather, use, protect, share, transmit, delete, or otherwise process (collectively Process).

 

This Privacy Policy describes Morris practices in connection with Personal Data Processed through software platforms and applications, websites, event management and registration platforms, social media pages, external marketing activities, mobile applications, email messages, and other communications, i.e., customer support requests, surveys, and SMS texts (collectively Services).

 

This Privacy Policy does not apply to information collected by or through any third party, including thirdparty applications or content (including advertising) that links to, or is accessible from, Morris applications and/or websites.

 

GENERAL INFORMATION

The word “you” refers to individuals who access and use the Services. By visiting and/or using the Services, you agree to be bound by all terms, conditions, and notices contained and/or referenced in this Privacy Policy and consent to having Personal Data transferred and/or Processed. If you do not agree to this Privacy Policy, please do not use the Services.

 

For example: You may be a client who accesses and uses the Services as the host or organizer of an event (Client), and with whom Morris has entered into an agreement containing separate terms and conditions governing delivery, access, and use of the Services (Client Agreement). You may be the employee or agent of a Client, who is authorized to access the platform as an administrator. Or, you may be a visitor to the website interested in browsing and learning more about a Morris product and/or service.

 

CONSENT

If you are invited to, registering for, checking into, or receiving information regarding a Client event through Service, you will be considered a “Participant” and Morris will provide any Personal Data submitted through the Service to the Client organizing that event. Morris does not control Client event registration, management process, or the Personal Data that a Client requests from Participants. Morris is not responsible for any decisions or actions taken by a Client with respect to your information (or by any third party with whom a Client may share your information). Please read the applicable privacy policies of the Client who is organizing the event before submitting Personal Data in connection with that event.

 

When Morris collects information from you, Morris may do so on its own behalf (in which case Morris will be considered a “controller” of your data), or on behalf of a Client who is using the Services to organize an event and manage other event-related activities (in which case, the Client will be the “controller” and Morris will be considered a “processor” of your data).

 

By submitting information to Morris, you agree to allow Processing of Personal Data in accordance with this Privacy Policy and as permitted or required by law. If you choose to refuse or withdraw your consent, Morris may not be able to provide you with normally offered Services. If you provide Personal Data regarding any third party, you represent that you have all necessary authority, and/or have obtained all necessary consents from said third party, to allow Morris to Process Personal Data as set forth in this Privacy Policy.

 

PROCESSING

With respect to the Personal Data of EU residents, Morris complies with applicable requirements of the General Data Protection Regulation (EU) 2016/679 as it applies to Personal Data. Morris’ use of Personal Data Processed through Services shall be limited to the purposes of providing the service for which Morris has been engaged by you and/or Client. Personal Data Processed in accordance with law may include, without limitation, name, gender, addresses (street, mailing, e-mail), phone number(s), credit and/or debit numbers or other payment data, language preferences, date and place of birth, governmentissued identification data (nationality, passport, visa, etc.), important dates, membership or loyalty program data, employer details, family member/companion data, digital images, video and audio data, and personal preferences.

 

Cookies, beacons, tags, and scripts may also be used by Morris and our integration partners or analytics and service providers. Morris receives and stores certain types of information whenever you interact with Morris, including website(s) and app(s). Such information may include login information, browsing history, preferences, location, and other personalization information. These technologies are used in enabling the applicable feature or widget functions properly, enabling certain customized features, storing user preferences, analyzing trends, administering websites, tracking user movement around the Services, and to gather demographic information about the user base as a whole. Morris may receive reports based on the use of these technologies by partners or providers on an individual as well as aggregate basis.

 

COLLECTION FROM CHILDREN

Services are not directed to, or intended for use by, children (defined as anyone under 13 years old). Morris does not market any products or services or knowingly Process any Personal Data from children. Morris requires children to receive consent from their parent or legal guardian before providing any Personal Data online.

 

HOW PERSONAL INFORMATION IS USED

Personal Data is used when and where it is necessary to provide Client and/or you with Services as part of the Morris relationship via Client Agreement (which may include, without limitation, responding to inquiries, fulfilling request, providing customer support, and as necessary for Morris to comply with applicable law), where Morris has previously been informed or authorized by Client and/or you. Also, please note that if information is aggregated or anonymized so that it is no longer reasonably associated or trackable to an identifiable natural person, it is no longer considered Personal Data under this Privacy Policy and Morris may use it for any legitimate and lawful business purpose.

 

THIRD PARTY

Morris website(s) may include links to other websites whose privacy practices differ from those of Morris. If you submit Personal Data to any of those sites, your information is governed by their privacy policies. You are encouraged to carefully read privacy policies of any website you visit. Also, please be aware that Morris is not responsible for the collection, use, and disclosure policies (including privacy practices) of other companies. Morris may use third party contractors to provide certain Services and perform functions on Morris’ behalf.

 

Morris may provide your Personal Data only to the extent necessary for such third party service provider to perform the duties for which it has been retained. Any such, third parties will be bound to strict confidentiality and use obligations with respect to your Personal Data, which are no less protective than those set out in this Privacy Policy. If Morris’ Clients are accessing any Service as an administrator, an authorized user of Client, or as a Participant for an event organized by a Client, Morris is permitted to provide Client with your information including, without limitation, your Personal Data, access information, and usage data.

 

INTERNATIONAL

Morris, through a third party vendor, participates in and has certified its compliance with the EU-U.S. Privacy Shield Framework and the Swiss-U.S. Privacy Shield Framework. Morris is committed to subjecting all Personal Data received from European Union (EU) member countries and Switzerland, respectively, in reliance on each Privacy Shield Framework, to the Framework’s applicable Principles.

 

Morris, through a third party vendor, is responsible for the Processing of Personal Data it receives, under each Privacy Shield Framework, subsequently transfers to a third party acting as an agent on its behalf, and complies with the Privacy Shield Principles for all onward transfers of Personal Data from the EU and Switzerland, including the onward transfer liability provisions.

 

In compliance with the Privacy Shield Principles, Morris commits to resolve complaints about Process or use of your Personal Data. EU and Swiss individuals with inquiries or complaints regarding the Privacy Shield Principles should first contact Morris at dataprivacy@morrisincentives.com.

 

Cross-Border Transfers other than to the EU or Switzerland

Personal Data may be accessed by Morris personnel providing Services in any country in which third parties are engaged to fulfill global Client Agreements. This means that Morris may transfer Personal Data outside the EU or US. In such instances, Morris uses Standard Contract Clauses approved by the European Commission to protect Personal Data.

 

RETENTION

Morris only retains Personal Data for as long as necessary to fulfill the purposes for which it was Processed, required by applicable law, or until you request deletion as described in this Privacy Policy.

 

Morris will also retain and use Personal Information for a period of time required to comply with legal, tax, audit or regulatory obligations, resolve disputes, and to enforce Client Agreements. Morris may retain Non-Personal Data for as long as necessary for the purposes and uses described in this Privacy Policy, including as necessary for Morris to pursue legitimate and lawful business interests.

 

ACCESS, CORRECT, UPDATE, OR DELETE INFORMATION

To submit requests to access, correct, update, or delete Personal Data, to no longer receive communications, or to “opt-out” of certain Services, contact Morris at dataprivacy@morrisincentives.com. In your request, please make clear what Personal Data you would like to have corrected, updated, deleted, or other limitations you would like to put on the use of your Personal Data.

 

Please be aware that Morris may need to retain certain Personal and Non-Personal Data for recordkeeping and archival purposes, or to complete any transactions you initiated prior to requesting such change or deletion. Once Morris has received notification that you withdraw your consent, Morris will no longer Process your information for the purpose(s) to which you originally consented unless there are compelling legitimate grounds for further Processing which override your interests, rights, and freedoms or for the establishment, exercise, or defense of legal claims. Your Personal Data will be stored in secured locations and on servers controlled by Morris, located either at Morris offices or at the offices of service providers.

 

SECURITY / PROTECTION

Morris will keep your Personal Data confidential and limit access to those who specifically need it to conduct their business activities, except as otherwise permitted by applicable law. Morris refers to industry standards and uses reasonable administrative, technical, and physical security measures, dependent on the sensitivity of the information, to protect Personal Data from unauthorized access, destruction, use, modification, or disclosure and in the ways in which Morris Processes said Personal Data. Morris requires industry standard data security measures from those third parties who are authorized by Morris to Process Personal Data on its behalf.

 

While Morris takes reasonable steps to protect Personal Data, please be aware that no method of internet transmission or electronic storage guarantees complete protection or is 100% secure, and there is always some risk when you share Personal Data online. Morris therefore cannot guarantee the absolute security of Personal Data.

 

CALIFORNIA PRIVACY RIGHTS

If you reside in California and have provided Personal Data to Morris, you can request, free of charge once per calendar year, information about the sharing of certain categories of Personal Data, to third parties and within Morris, for direct marketing purposes. Morris will provide a list of the categories of Personal Data disclosed to third parties for their direct marketing purposes during the immediately preceding calendar year, along with the names and addresses of these third parties. Such requests should be submitted to dataprivacy@morrisincentives.com. Morris reserves the right not to respond to requests submitted to addresses other than the addresses specified in this subsection.

 

SENSITIVE INFORMATION

Morris, when Processing information as a data controller, will not request any sensitive Personal Data such as your health history, race, religion, or sexual orientation. Morris requests you do not send such sensitive Personal Data on and/or through website(s), by e-mail, or through any other means. 

 

UPDATES TO PRIVACY STATEMENT

Morris may change this Privacy Policy at any time by posting revisions to this Privacy Policy. Therefore, you should review this Privacy Policy from time to time. By continuing to access and use the website(s) and/or Service(s) after such change, you agree to be bound by the terms of the revised Privacy Policy. Information you submit to Morris is controlled by the Privacy Policy in effect at the time of submission. If you do not accept all of the terms, conditions, and notices set forth in this Privacy Policy, you must exit the Services immediately.

If you are a Participant, please direct any questions you may have regarding your Personal Data to the Client organizing the event, not to Morris. As noted previously in this Privacy Policy, if you are a Participant for an event organized by a Client, Morris Processes your Personal Data on behalf of that Client.
